New filings in Godlewski's defamation case against the Scranton Times.

Discovery time!

The Scranton Times is trying to get Godlewski to answer some questions for the court, including his definition of the "firmament", the basis of his statement that "planets aren't rock but beams of energy trapped inside the firmament", and his past claim that Tom Hanks is dead.

Phil Godlewski doesn't seem to understand when he advances claims to the court and to the defendants in writing, the defendants get discovery also. He has to support the claims he's making before the case goes to trial.

Discovery is not a one way street. It goes both ways. You can't make claims in a filed lawsuit against the defendants and then not show the court any evidence to back up what you are claiming before the trial starts. You have to meet your discovery obligations first.

Which Phil hasn't done.

Godlewski's testimony on the stand under oath in front of the jury is not going to be sufficient. He will have to provide the court with the prerequisite financial documentation.

If Phil should, let's say, claim to the court and to Chris Kelly and the Scranton Times-Tribune that he suffered great financial loss due to the news story about him that they published, that means Phil bears the burden of demonstrating the financial loss he claims to have suffered via official documentation.

The defendants have asked Godlewski repeatedly to provide documentation to verify this loss of income that he is claiming. Thus far, Godlewski does not seem to have produced to the court or to the defendants any documentation to support his claim of having suffered financial loss due to a published news story based on official police and court records.

If you can't or won't support a lawsuit claim with evidence, you shouldn't be making it to the court in the first place.

Assuming this case ever did make it to trial and the jury ruled in Godlewski's favor, how is the court going to determine the amount of damages Godlewski should be awarded if he's never backed up his claims of loss of financial income with any documentation?

"Just take take my word for it, these guys owe me $5 million dollars." and $1.50 will get you a $1.50 worth of coffee. And that's it.

Reading this latest filing, which is just 1 of the 19 court cases Godlewski has been involved in since 2010 that I've looked through, he doesn't seem to have a very strong case.

He has not produced basic discovery materials. and now the defendants are asking the court to light a fire under Phil's ass and make him start meeting his legal obligations, if indeed he is serious about pursuing this defamation lawsuit against them.

Which I don't think he is.

He's had over a year to meet discovery obligations and thus far he hasn't done it. Which is what's stalling his own defamation lawsuit from proceeding any further.

Beutler, who voted to impeach President Trump and is one of the MAGA targets for 2022, now has 41,603 votes. Trump-endorsed Joe Kent has moved from a several thousand vote deficit, into the latest result of 41,346 votes.  The difference is now down to 257 votes, with 20,000 left to count.
