As I explained on my show the other night, this was always a possibility and it isn't necessarily a bad thing.
I'd bet on DOJ losing this appeal, thus making the precedent being set that much stronger.

Danchenko case:
Neither side disputes that this anonymous call took place. Durham is charging that Danchenko lied when he said he believed it was from Sergei Millian.
In order for that to be a lie, Durham must have evidence that Danchenko knew who the anonymous caller was.
So, who was the anonymous caller?
Perhaps it was Danchenko's handler?
