The fear of the lawyers would be if the STF, as is common, continued to increase or maintain the penalty. By doing so, according to the law, the STF could lead to the commission of a crime, being the abuse of the judiciary, while there is no plausible reason for the fine.
According to the Crime of Abuse of Authority (Law 4.898/65), it becomes possible to apply the aggravating factor of Art. 61, II, g, of the Penal Code, in the form of Abuse of Power.
For the lawyer, "the judiciary wanting at any cost to ban an account through fines, coercion, and without plausible reason, characterizes an obvious abuse of authority".

The area for the final disposal of the hull, located in Águas Jurisdicionais Brasileiras (AJB), 350 km from the coast and with a depth of approximately 5 thousand meters, was selected based on studies conducted by the Navy Hydrography Center and the Institute of Studies of Sea Almirante Paulo Moreira. The analyzes considered aspects related to navigation safety and the environment, with special attention to the mitigation of impacts on public health, fishing activities and ecosystems.
