控罪：非法集結
上述被告被控於2019年11月18日，在香港九龍尖沙咀科學館道一帶，連同其他不知名人士集結在一起，作出擾亂秩序的行為或作出帶有威嚇性、侮辱性或挑撥性的行為，意圖導致或相當可能導致任何人合理地害怕如此集結的人會破壞社會安寧，或害怕他們會藉以上的行為激使其他人破壞社會安寧。

本案用了26個工作天進行審訊，控方在審訊時傳召了26名證人；辯方有16名被告作供，另有2名辯方證人。

控方案情：

控方案情指於2019年11月18日約08:05時，有約50名身穿黑衣和戴有頭盔、防毒面具等裝備的示威者打開約20把雨傘叫著「一二、一二」的口號，在警方於科學館道與科學館廣場交界附近的警方防線前嘗試向防線推進，要求警方釋放在理大內的人。當人群接近警方防線近30米前時，警方發出口頭和旗號警告，但人群後退但不散開，仍留在科學館廣場內築起傘陣。

於同日約08:15時，警察機動部隊Y4小隊由麼地道72號經華懋廣場和南洋中心之間的小徑進入科學館廣場。警察機動部隊Y1及Y3小隊亦於這時到達科學館道與科學館廣場交界的位置。這時，有100至200人集結在一起，當中前排人群約有20人築起傘陣和辱罵警察。警方再以揚聲器發出警告，但集結人群沒有按警方要求離場。當後來警察機動部隊Y1及Y3小隊向示威者方向前進時，示威者逃走。

於同日約08:18時，警察機動部隊Y1及Y3小隊同時上前圍捕在場人士。督察2566於同日約08:20時，在科學館廣場的華懋廣場對開外以涉嫌干犯「暴動」罪正式拘捕了總共135人，當中包括本案20名被告。同時間，有16把雨傘和示威者的防禦裝備散滿一地，包括：

⁃ 1個黑色背囊，內有2個黑色腰包、4個護目鏡、4個防毒面具、1枝噴漆、10枝生理鹽水、3個口罩、1件灰色T恤、2包紙巾、6隻手套、1個金色充電器、及1副眼鏡連眼鏡盒。

被搜出「裝備」且有作供的被告，即除A1和A10外的被告，他們指沒有意圖使用「裝備」以參與非法集結，或是給「裝備」予他人使用以參與非法集結；他們管有這些「裝備」是有正當目的。

就警方的行動而言，有被告作供時提過有Y4小隊的隊員曾在麼地道小徑驅趕人群。此外，有被告作供時提過有警員將在近新文華中心的車路的人拘捕，並叫他們走到華懋廣場的被捕人群當中。

最後，案件會於2023年10月19日10:00繼續，作結案。
