Im sogenannten AI Act der EU, welcher den Einsatz von KI regeln und Ende 2023 / Anfang 2024 beschlossen werden soll, wird europaweit gesetzlich verankert, was KI darf. Es wird weltweit das erste Regelwerk in diese Richtung sein und international mit großem Interesse verfolgt. Anfang Dezember 2022 hatte sich der Rat der Europäischen Union, also alle 27 Mitgliedsländer, auf eine gemeinsame Position beim AI Act geeinigt.
Offiziell dient es dem Schutz der Menschen beim Einsatz von künstlicher Intelligenz. Bei genauerer Betrachtung ist das eine Farce: Außer Echtzeitüberwachung wird fast alles möglich sein. Es wäre naiv anzunehmen, dass dies „zur Sicherheit aller“ nicht dennoch eingeführt werden könnte.
Die Position der BRD zur biometrischen Gesichtserkennung beim EU AI ACT: „Eine retrograde biometrische Identifizierung, z.B. bei der Beweiswürdigung, darf jedoch europarechtlich nicht ausgeschlossen werden.“
Es gibt jetzt schon definierte Ausnahmen, bei denen fast alles möglich sein wird: Im Kriegsfalle und bei der Gefährdung der nationalen Sicherheit. Wie letzteres genau definiert wird, bleibt unbeantwortet.
Explizit nicht im Papier geregelt: Einspruchs- und Entschädigungsmöglichkeiten. Wenn der Mensch sich beispielsweise gegen unrechtmäßige Echtzeitüberwachung wehren möchte, findet man dazu keinerlei Informationen. Das lässt den Rückschluss zu, dass dies schlicht nicht vorgesehen ist.
